The federal Form I‑9 is scheduled to expire on July 31, 2026, and we’ve received a few questions about whether this means employers need to have all employees complete new forms. The good news is that no re‑verification is required. Existing I‑9s remain valid, and you do not need to redo forms for current staff.

The expiration date only affects which version of the form must be used for new hires going forward. Once USCIS releases the updated edition, employers will simply begin using the new version for anyone hired after that date.

You do need a new I‑9 only in specific situations – such as a rehire where the original form can’t be reused, an employee’s work authorization expires, or if the original I‑9 contains errors that can’t be corrected.
